Eibhlin McCloskey

Eibhlin started her legal career as Associate to the Honourable Justice Owen at the Supreme Court of Western Australia, after graduating with a Bachelor of Laws from the University of Western Australia in 1994. Since being admitted to practice in 1997 Eibhlin has specialised in commercial litigation and dispute resolution work, with a particular focus on intellectual property matters and insolvency issues.
Eibhlin joined Tottle Partners in 2001 and became a partner of the firm on 1 January 2010.
Eibhlin’s practice includes:

advising on risk management and best practice strategies for the protection of intellectual property and associated rights and the enforcement of those rights as required;

drafting software and intellectual property licensing agreements, non-disclosure and confidentiality agreements, joint venture and other commercial agreements for and in connection with the protection and commercial exploitation of intellectual property rights;

providing advice and acting for clients in trade mark applications and opposition proceedings in the Trade Marks Office of Australia and in related litigation;

assisting clients in applications for the grant of patents, in conjunction with services provided by specialist patent attorneys;

acting in alternative dispute resolution processes and in litigation (at first instance and appellate level) in disputes concerning patent, trade mark and design infringements; restraint of trade issues and claims relating to the misuse of confidential information against and by employees, breaches of statutory and common law duties owed by employees and Corporations Act matters generally;

advising and acting for clients and insolvency practitioners in disputes connected with voluntary administrations, liquidations and other forms of external administrations.
Eibhlin acts for a diverse range of clients including a privately owned national communications carrier; financial services software providers; not-for-profit organisation; fabrication, engineering and construction companies. Eibhlin also acts for AHPRA in commercial litigation matters and represents a number of insolvency practitioners in her advisory capacity and also in litigation matters.
Eibhlin is a member of the Licensing Executives Society of Australia and New Zealand.
